Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Earn to Play mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

If you are using the App on behalf of a minor child, you represent that you are the child's parent or legal guardian and you agree to these Terms on behalf of yourself and your child.

2. Description of Service

Earn to Play is a parental control application that allows parents/guardians to:

• Set screen time limits for children's devices
• Create educational quests and activities
• Reward children with screen time for completing tasks
• Monitor and manage children's app usage

3. Eligibility

• Parent/Guardian Accounts: You must be at least 18 years old (or the age of majority in your jurisdiction) to create a parent account.
• Child Accounts: Child profiles may only be created by a parent or legal guardian who has authority over the child.
• You must have legal authority to install the App on any device you manage.

4. Account Registration

• You must provide accurate and complete registration information
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities under your account
• You must immediately notify us of any unauthorized use of your account

5. Parental Consent

By creating a child profile and enabling monitoring features, you represent and warrant that:

• You are the parent or legal guardian of the child
• You have legal authority to monitor the child's device usage
• You consent to the collection and use of data as described in our Privacy Policy
• You understand that the App will monitor and potentially restrict the child's device usage

6. Acceptable Use

You agree NOT to:

• Use the App on devices you do not own or have authority to manage
• Use the App to monitor adults without their explicit consent
• Attempt to bypass, disable, or circumvent any security features
• Reverse engineer, decompile, or disassemble the App
• Use the App for any illegal purpose
• Share your account credentials with unauthorized persons
• Create multiple accounts to abuse features or promotions

7. Subscription and Payment

Free Features

Basic parental control features are available for free.

Premium Features

Advanced features may require a paid subscription. Subscription terms:

• Subscriptions are billed monthly or annually
• Payment is charged to your App Store or Google Play account
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period
• You can manage subscriptions in your device's app store settings

Refunds

Refund requests are handled by Apple App Store or Google Play Store according to their respective policies.

8. Intellectual Property

The App, including all content, features, and functionality, is owned by Earn to Play and is protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

9. User-Generated Content

When parents create quests or upload content:

• You retain ownership of your content
• You grant us a license to use, store, and display your content within the App
• You represent that you have the right to share such content
• You agree not to upload inappropriate, offensive, or illegal content

10. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

• Merchantability and fitness for a particular purpose
• That the App will be uninterrupted or error-free
• That the App will be completely secure
• That the App will effectively prevent all unauthorized device usage

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EARN TO PLAY SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, or consequential damages
• Loss of data, profits, or business opportunities
• Any damages resulting from unauthorized access to or alteration of your data
• Any actions taken by children that the App failed to prevent

Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Earn to Play from any claims, damages, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you create or upload

14. Termination

We may suspend or terminate your access to the App at any time for:

• Violation of these Terms
• Suspected fraudulent or illegal activity
• Non-payment of subscription fees
• Any other reason at our sole discretion

Upon termination, your right to use the App ceases immediately. You may request deletion of your data per our Privacy Policy.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting updated Terms in the App
• Sending an email notification
• Displaying a notice in the App

Continued use of the App after changes constitutes acceptance of the new Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the European Union and the applicable member state, without regard to conflict of law principles.

17. Dispute Resolution

Any disputes arising from these Terms shall be resolved through:

1. Good faith negotiation between the parties
2. Mediation by a mutually agreed mediator
3. Binding arbitration as a last resort

18. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Earn to Play regarding the App.
