Invitation-only Closed Beta Terms
These Terms govern the invitation-only closed beta for participating families and are operative for that beta. Before any public or global launch, they must be reviewed and re-approved, including the governing-law and venue wording, public feature set, billing terms if any, store distribution, and completed compliance workflows.
1. Acceptance of Terms
These Terms govern access to and use of the Earn to Play mobile applications and child/parent web portals during the invitation-only closed beta (together, the "Service"). By creating an account or using the Service, the participating adult agrees to these Terms for themselves and for the minor child they are authorized to represent.
Service operator: Trukhnova Olha, Avenida Alas ClarĂn 16, 4.Âș Izq., 33404 AvilĂ©s, Spain. Phone: +34 671 918 928. Email: v.trukhnov@gmail.com. Earn to Play is operated by the individual named above; these Terms do not represent Earn to Play as a separately incorporated company.

- Use web portals for temporary child access, no-media quest completion requests, and parent review where those web features are enabled

8. Intellectual Property
For the closed beta, participants receive a limited, personal, non-transferable right to use the Service for invited family testing. Intellectual-property, governing-law, and license language must be reviewed and re-approved before any public or global launch.
9. User-Generated Content
When parents create quests or submit content metadata for the App:
- You retain ownership of your content
- You grant us a limited license to process and display quest text, metadata, and parent-provided content inside the App as described in the Privacy Policy. Current tracked child media is intended to stay local on the child device; Firestore stores review/status metadata and local path references, while cleanup after review and full erasure remain under verification.
- You represent that you have the right to share such content
- You agree not to submit inappropriate, offensive, or illegal content
10. Privacy
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.
11. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:
- Merchantability and fitness for a particular purpose
- That the App will be uninterrupted or error-free
- That the App will be completely secure
- That the App will effectively prevent all unauthorized device usage
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EARN TO PLAY SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, or consequential damages
- Loss of data, profits, or business opportunities
- Any damages resulting from unauthorized access to or alteration of your data
- Any actions taken by children that the App failed to prevent
No paid-plan terms are offered by these Closed Beta Terms. Before any payment is accepted, separate billing, renewal, cancellation, refund, and liability terms must be approved and published.
13. Indemnification
You agree to indemnify and hold harmless Earn to Play from any claims, damages, or expenses arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any third-party rights
- Any content or data you create or submit through the App; current tracked child media files are intended to stay local, while Firestore may store review metadata and local path references
14. Termination
The operator may suspend closed-beta access when reasonably necessary for security, abuse prevention, legal compliance, or protection of a child or family. A participating adult may stop using the Service at any time and request withdrawal of consent, export, or deletion through the available portal controls or the contact below.
Deletion and export requests are governed by the Closed Beta Privacy Policy and may require manual support while the complete automated workflow is implemented.
15. Changes to Terms
We may update these Terms during the closed beta. We will publish the effective date and provide notice or request renewed acceptance when required or when a change is material. These Terms must be reviewed and re-approved before any public or global launch.
16. Governing Law
These Closed Beta Terms use the laws of Ukraine as the intended governing law. This choice does not exclude or limit any mandatory rights or protections that cannot lawfully be waived, including applicable European Union and Spanish consumer and data-protection rights and rights under the GDPR. The operator's reported Ukrainian tax residence and Spanish contact address do not, by themselves, state incorporation, establishment, or an exclusive court venue. Governing-law, venue, and conflict-of-law wording must be reviewed again before any public or global launch.
17. Dispute Resolution
These Closed Beta Terms do not establish mandatory arbitration or an exclusive court venue. Participants should first contact the operator using the details below. A public-launch dispute process must be reviewed and approved with the final governing-law and venue wording.
18. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
19. Entire Agreement
These Terms together with our Privacy Policy form the agreement for the invitation-only closed beta.
